Body In Balance Therapy Privacy Policy

1. Body In Balance Therapy Privacy Policy: About Us

Body In Balance Therapy is a small, wellness practice in Merritt Island, Florida. We serve clients throughout Brevard County, including Merritt Island, Viera, Melbourne, Cocoa, Titusville, and nearby communities. Our services include advanced skincare and aesthetic treatments (including NanoInfusion and Nanochanneling, Luminfusion, ProCell Skin and Hair Microchanneling, and Dermalogica Pro microneedling and skin treatments), as well as therapeutic massage, manual and post-surgical lymphatic drainage, sports therapy, and non-invasive body contouring.

2. Body In Balance Therapy Privacy Policy: Information We Collect

What we collect depends on how you work with us. Most of the time, that means basic contact and account details, like your name, email address, phone number, mailing or billing address, appointment details, and the information we need to set up and manage your client account. We may also collect your date of birth for age verification and, if you choose, for birthday-related messaging.

If you decide to share it, we may collect health-related information that connects to the services you request. This can include medical history, conditions, medications, allergies, skin sensitivities, injuries, surgeries, recovery status, contraindications, and your treatment goals. We rely on what you tell us to make safe service decisions. If information is missing or not accurate, it can affect what we can offer and the results you experience.

We also keep the normal records that come with doing business, such as purchase and transaction details, messages and other communications with you, records from our client platforms, and basic website and device information that may be collected automatically when you use our site, such as browser type, pages visited, identifiers and log data, approximate location, and similar usage information.

3. Body In Balance Therapy Privacy Policy: What Happens If You Choose Not To Provide Information

You can choose not to share information with us. If you do, we may not be able to book you, respond to your request, process a purchase, verify identity, confirm age requirements, or provide services in a way we consider safe and appropriate. If something important is missing, incomplete, or cannot be verified, we may need to decline, postpone, adjust, or stop a service. If you choose not to provide necessary information, we may decline to provide the service.

You are responsible for keeping your information accurate, complete, and up to date, and for telling us when something changes, including health information that may affect your services. We will only ask for information we reasonably need for your booking, purchase, or service.

4. Body In Balance Therapy Privacy Policy: How We Collect Information

We collect information when you contact us, book an appointment, fill out intake or consent forms, receive a service, make a purchase, buy or redeem a gift certificate, enroll in or use a package or membership, or sign up for messages. We may also receive information through the providers and systems we use to run the studio, such as booking and scheduling, payments, website hosting, email, text messaging, marketing, analytics, and client communications. Depending on the tool, information may be collected directly from you or automatically through that system, and your use of that tool may be covered by its own terms, privacy policy, and data practices.

5. Body In Balance Therapy Privacy Policy: How We Use Information

We use information to run the studio and support your services. That includes scheduling and managing appointments, providing and documenting services, considering health information you choose to share, processing purchases and payments, managing gift certificates, packages, and memberships, and sending appointment reminders and other messages tied to the services you requested.

We also use information to protect the business and keep things running smoothly. That includes recordkeeping, service improvements, fraud prevention, safety and security, handling disputes and chargebacks, and enforcing our Terms & Conditions, booking terms, consent forms, and other agreements. We use your contact information for promotional messages only as described in the Marketing, Email and Text Messages section below.

6. Body In Balance Therapy Privacy Policy: Health Information and Your Records

We may collect health information you choose to share because it helps us provide safe, appropriate care. We use it to plan and deliver your treatment, document what we did, and support normal studio operations. When it makes sense for your care, we may share relevant health information with treatment providers involved in your care. We may also use or disclose information when the law requires it.

We take privacy seriously and use reasonable administrative, technical, and physical safeguards to protect health information and other sensitive details. Access is limited to what is reasonably needed, and we train our team on privacy and confidentiality. We do not sell personal information. We also do not use health information for marketing unless you give us written consent.

Body In Balance Therapy is a licensed massage therapy practice. Florida law treats licensed massage therapists as health care practitioners under Chapter 456. Florida law also gives clients certain rights related to their records, including the right to request a copy. Your records are governed by Florida patient-record requirements, and a reasonable copying cost may apply where permitted by law. Florida’s Information Protection Act also treats certain medical information as protected personal information. If a security incident involves personal information and the law requires notice, we will notify you within the required timeframe, which may be 30 days after we determine a breach occurred.

If you want to seek reimbursement from an insurer or other payer, you can ask us for a super bill or itemized receipt. You handle any reimbursement request directly with the insurer or payer, and we do not submit claims for you.

7. Body In Balance Therapy Privacy Policy: Payment Information

We use third-party payment providers to process payments. We do not store full payment card numbers. Your payment provider may collect and process payment details under its own privacy practices and terms. We may keep transaction details and related identifiers, like amounts, dates, what was purchased, and payment status, so we can manage accounts, keep proper records, respond to disputes or chargebacks, prevent fraud, and handle accounting or legal needs.

8. Body In Balance Therapy Privacy Policy: Booking and Client Platforms

We use our booking and scheduling platform for appointments and related client services, and we may use other ecommerce platforms for online product sales if and when that store is available. These 3rd party companies have their own terms and privacy policies. Information you enter into any booking, payment, or ecommerce platform may be processed under that provider’s own privacy policy and terms, and you are responsible for reviewing them before you share information through the platform.

We use the information we receive through our booking and sales platforms to manage appointments, purchases, packages and memberships, gift certificates, client requests, communications, and studio records.

9. Body In Balance Therapy Privacy Policy: Website Hosting, Cookies, Analytics, and Advertising

Our website is hosted by Wix. The website and the tools used on it may use cookies, pixels, tags, SDKs, and similar technologies. These tools help the site work properly, remember settings, support embedded features, measure performance, understand how people use the site, and support marketing and advertising. We may use analytics and advertising tools, including third-party analytics and advertising services, and those services may collect information about your browsing activity and interactions across this and other websites or apps over time.

We do not sell personal information.

10. Body In Balance Therapy Privacy Policy: Marketing, Email and Text Messages

We may send promotional emails if you sign up or otherwise agree to receive them. You can opt out at any time using the unsubscribe link in a marketing email. Even if you opt out of marketing, we may still send messages that are needed to manage your bookings, your account, or services you requested.

We send marketing text messages only when you give written consent. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of marketing texts or HELP for help. Appointment reminders and messages needed to manage a booking or provide a service you requested are transactional, not marketing, and opting out of marketing does not stop necessary service-related messages.

11. Body In Balance Therapy Privacy Policy: Photography, Reviews, and User Content

This Privacy Policy explains how Body In Balance Therapy do not take, publish, share, or use photographs, video, testimonials, reviews, or before-and-after images of an identifiable client for any purpose, including marketing or social media, unless the client gives prior written consent. Consent is always voluntary. You can say no, and it will not affect your booking or your services. You can also withdraw consent at any time in writing. If you withdraw consent, we will stop using the material going forward. We may also decline to publish content, or remove it later, at our discretion.

We do not post fabricated reviews, and we do not offer incentives for reviews or make any service, discount, or benefit dependent on leaving a review. If you submit content to us (including photos, videos, messages, testimonials, or other materials), you are confirming it is truthful and that it does not violate anyone else’s rights. Withdrawing consent does not change anything that already happened or anything that was already published where removal is not reasonably possible. A public review you post does not give us permission to use your image or private treatment information in our marketing.

We may take photos or videos of our studio, treatment areas, and equipment for business purposes. We do not include identifiable clients in that content without prior written consent.

12. Body In Balance Therapy Privacy Policy: Gift Certificates, Packages and Memberships

We may offer gift certificates, packages, and memberships. To sell, manage, verify, and redeem them, we keep the information we reasonably need. That can include purchaser or recipient details, purchase history, balances, session use, renewal information, payment authorizations, and related messages. We may ask for verification of a gift certificate or membership, and we may ask to verify the identity of the person presenting it. If you buy through an outside platform, that platform may handle information under its own privacy policy.

Gift certificates are non-transferable and non-refundable. They are not redeemable or convertible for cash, and they are not replaceable if lost or stolen. Gift certificates are subject to Florida Law regarding expiration dates. A gift certificate has value only as payment for eligible services, treatments, packages, and memberships, and it cannot be used to purchase retail products. A gift certificate is not a financial instrument and does not earn interest. We are not responsible for a certificate that is lost, stolen, or used without authorization.

If you miss an appointment or cancel without at least 72 hours’ notice, you may forfeit a gift certificate used to reserve that appointment time. Appointments booked with a gift certificate follow the same booking, cancellation, late arrival, and no-show rules as any other appointment. We require a card on file for all appointments, including those booked with a gift certificate.

We may refuse a gift certificate that is altered, duplicated, counterfeit, unverifiable, expired, or that we reasonably believe was obtained or is being used unlawfully. If we find a certificate is being used for fraud or unlawful purposes, we may cancel it without refund. We may also refuse to accept a certificate when the terms of its issuance are not met.

Packages and memberships are for the client’s personal use only. They may not be shared, transferred, or resold, and they are non-refundable. Packages and memberships must be used within their stated validity period starting on the purchase date. Unused sessions or benefits do not roll over and are not convertible to cash or credit unless a specific written agreement says otherwise. Memberships renew automatically for successive terms until cancelled. You can cancel any time before the next renewal date, and the cancellation takes effect at the end of the current paid term. There is no cancellation fee. If you cancel after a renewal charge has posted, you remain responsible for that renewal period. By enrolling, you authorize payments using the card on file. We may suspend, modify, or terminate membership or package benefits if we see misuse, abuse, attempted resale, fraudulent payment, or conduct that breaks our policies.

13. Body In Balance Therapy Privacy Policy: Misuse, Fraud, Cancellations, No-Shows, and Booking Enforcement

We collect and authorize a card before booking all appointments. We require at least 72 hours’ notice to cancel or reschedule. If you cancel with less than 72 hours’ notice or do not show up, we charge 50% of the scheduled treatment price to the card on file. This is to cover the reserved appointment time, not to punish you. If you arrive 15 minutes or more late, we may treat it as a no-show, and your appointment time does not get extended. You authorize these charges when you provide your card at booking.

To cancel or reschedule, you must text only at 321-313-1882, 321-610-0887.  If you submit a request through a third-party platform, it is not effective until we confirm it. Please do not assume your request has been accepted until you hear from us. If there are repeated late cancellations or no-shows, we may require prepayment or decline future bookings. We may also limit booking access when charges are unpaid or disputed.

We may refuse, suspend, or terminate services and cancel bookings if we reasonably believe someone has given false or misleading information, left out important health information, used an unauthorized payment method, filed an improper chargeback, misused a package, membership, or gift certificate, tried to resell services, acted abusively or threatened anyone, or engaged in unlawful or prohibited conduct. We may report suspected fraud or unlawful conduct to the appropriate authorities or the payment provider.

14. Body In Balance Therapy Privacy Policy: Sharing Information, Legal Disclosures, and Protection of Our Rights

We do not sell personal information. We may share information with service providers who help us run the studio, such as website hosting, booking and client management, e-commerce, payments, communications, marketing, analytics, and security support. These providers may process information for us and may also handle it under their own terms and privacy policies.

We may access, store, preserve, use, and share information when we reasonably believe it is needed to follow the law, respond to valid legal process or government requests, enforce our Terms & Conditions and other agreements, protect our rights and property, protect clients and our team, investigate suspected fraud or unlawful conduct, prevent or address security threats, or establish, exercise, or defend legal claims. Nothing in this policy limits our ability to meet legal obligations or protect our lawful interests.

15. Body In Balance Therapy Privacy Policy: Third-Party Links and External Platforms

Our website, booking tools, messages, or social media may link to other websites, apps, retailers, or platforms. We are not responsible for their privacy practices, security, content, tracking, data collection, retention, or terms. Please review the other party’s policies and terms before you share information, create an account, or buy anything through them.

16. Body In Balance Therapy Privacy Policy: Security, Service Availability, and Third-Party Incidents

We use reasonable safeguards designed to protect information. Even so, no system can be guaranteed completely secure. We cannot promise that unauthorized access will never happen, that electronic messages will always stay confidential, that third-party platforms will never have a security incident, that our website will always be available, or that third-party providers will always run without interruption, errors, or incidents.

To the fullest extent permitted by law, we are not responsible for security incidents, privacy practices, service interruptions, outages, errors, or data practices that are caused only by independent third-party providers outside our reasonable control. This does not exclude liability that cannot legally be excluded.

17. Body In Balance Therapy Privacy Policy: Your Choices, Privacy Requests, Disputes, and Enforcement

Subject to applicable law, you can ask to access or correct personal information we keep about you, request a copy of your records, or request deletion where the law requires or allows it. We may keep information when we reasonably need it to provide services, keep required records, respond to disputes or chargebacks, enforce our agreements, or meet legal obligations. You are responsible for keeping your contact and payment information current.

To make a privacy request, email Ro@bodyinbalancetherapy.us or call 321-313-1882 or 321-610-0887. We may need to verify your identity before we respond. We may rely on our booking records, appointment records, signed or electronic acknowledgements, consent forms, card-on-file authorizations, and communication records as evidence of your activity and agreement. Where allowed by law, we may recover reasonable costs, including collection costs or attorney fees, related to unpaid charges.

18. Body In Balance Therapy Privacy Policy: Changes to This Policy and Contact Us

We may update this Privacy Policy as our services, website, or information practices change. When we do, we will update the Last Updated date shown below, and the updated policy applies from that date.
