4. WEBSITE INFORMATION
We make reasonable efforts to provide accurate and current information on our website.
However, service descriptions, prices, availability, promotions, product information, photographs, educational materials, and other website content may change without notice.
We do not guarantee that all website information will always be complete, current, accurate, uninterrupted, or free from typographical or technical errors.
The availability of a service or product on the website does not guarantee that it will be available at a particular time.
5. PROFESSIONAL SERVICES AND SCOPE OF PRACTICE
Services are provided according to the practitioner’s professional judgment, training, qualifications, applicable law, and the circumstances presented at the time of service.
Different services may involve different techniques, equipment, products, levels of intensity, or treatment approaches.
Nothing in these Terms expands a practitioner’s legal scope of practice or authorizes any practitioner to perform services outside the practitioner’s lawful scope.
6. WEBSITE INFORMATION IS NOT MEDICAL ADVICE
Information provided through our website, social media, educational materials, communications, or other business content is provided for general educational and informational purposes.
It is not intended to constitute medical diagnosis, medical treatment, medical advice, or a substitute for evaluation by an appropriately licensed healthcare professional.
Body In Balance Therapy does not diagnose medical conditions through website content or general communications.
When medical evaluation or care is appropriate, you should consult an appropriately licensed healthcare professional.
7. CLIENT RESPONSIBILITY FOR ACCURATE INFORMATION
Clients are responsible for providing complete and accurate information relevant to their services.
You agree to disclose information that may reasonably affect the safety, suitability, or performance of a service, including relevant health conditions, medications, allergies, sensitivities, recent procedures, injuries, surgeries, treatments, or other information requested during consultation or intake.
You are responsible for notifying us if relevant information changes.
Failure to provide accurate or complete information may affect treatment suitability and may increase the risk of an adverse response.
Body In Balance Therapy and its providers are not responsible for consequences resulting from information that was withheld, incomplete, inaccurate, or not disclosed when reasonably requested.
8. CONSULTATION, TREATMENT SELECTION, AND PROFESSIONAL JUDGMENT
A service selected or requested by a client is not automatically appropriate for every individual.
Body In Balance Therapy and its practitioners reserve the right to determine whether a service is appropriate based on the information available at the time of consultation.
A practitioner may modify, postpone, decline, or discontinue a service when reasonably necessary because of safety concerns, contraindications, client circumstances, professional judgment, scope-of-practice limitations, or other legitimate considerations.
9. TREATMENT RISKS, CONSENT, AND CLIENT PARTICIPATION
Professional services may involve inherent or potential risks, including temporary redness, sensitivity, tenderness, discomfort, irritation, bruising, swelling, skin reactions, soreness, or other responses depending on the service.
Certain advanced skincare and bodywork services may involve additional risks or contraindications.
Clients are expected to follow reasonable pre-treatment and post-treatment instructions provided by their practitioner.
Where a separate informed-consent form or treatment-specific consent is required, that document must be completed before the applicable service is performed.
Client participation, communication, disclosure of relevant information, and compliance with professional instructions are important components of safe and appropriate care.
10. NO GUARANTEE OF RESULTS
Body In Balance Therapy does not guarantee any particular outcome from a service, treatment, product, package, membership, skincare program, bodywork service, or wellness service.
Individual responses vary based on numerous factors, including individual physiology, health history, skin condition, lifestyle, adherence to recommendations, frequency of treatment, and other circumstances.
Before-and-after photographs, testimonials, examples, educational materials, and descriptions of potential benefits are not guarantees of results.
11. RIGHT TO MODIFY, DECLINE, OR DISCONTINUE A SERVICE
Body In Balance Therapy and its providers reserve the right to modify, postpone, decline, or discontinue a service when reasonably necessary.
Reasons may include safety concerns, contraindications, professional judgment, scope-of-practice requirements, inappropriate conduct, failure to comply with policies, inability to safely provide the requested service, equipment or product limitations, or other legitimate business or professional considerations.
When reasonably possible, we may explain the reason for a modification or discontinuation.
12. APPOINTMENTS AND BOOKING
Appointments are reserved specifically for individual clients and represent time set aside by a practitioner.
A valid credit card may be required to reserve an appointment. No deposit is required unless otherwise specifically stated for a particular service, promotion, package, or transaction.
Appointment availability is not guaranteed until the appointment has been confirmed through an authorized booking process.
Third-party booking platforms may have their own technical requirements, but our business policies continue to apply.
13. CANCELLATION, RESCHEDULING, AND NO-SHOW POLICY
Because appointment time is specifically reserved for each client, cancellations and rescheduling requests require advance notice.
At least 72 hours’ notice is required to cancel or reschedule an appointment.
Cancellations or rescheduling requests made with less than 72 hours’ notice are subject to a 50% cancellation fee based on the scheduled treatment price. The fee may be charged to the card on file.
Failure to arrive for a scheduled appointment is considered a No-Show and is subject to a 50% fee based on the scheduled treatment price.
Arriving 15 minutes late or more may be considered a No-Show, and the applicable fee may be charged.
Clients must contact Body In Balance Therapy directly to cancel or reschedule. Cancellation or rescheduling requests should be made by text to:
+13213131882
+13216100887
Clients should not assume that a cancellation or rescheduling request submitted through a third-party platform has been accepted unless Body In Balance Therapy confirms the change.
Unexpected emergencies or unforeseen circumstances may be considered at the discretion of Body In Balance Therapy. Any exception is discretionary and does not create a continuing obligation to provide future exceptions.
14. OFF-HOURS APPOINTMENTS
Appointments requested and approved outside regular business hours may be subject to an additional fee.
Unless otherwise stated:
-
Weekday off-hours appointment: $20 additional fee.
-
Weekend appointment: $30 additional fee.
Off-hours appointments are subject to provider availability and must be approved in advance.
The applicable fee is intended to compensate the provider for accommodating appointments outside regular business hours and associated administrative or other costs.
15. PACKAGES AND MEMBERSHIPS
Package and membership purchases are subject to the specific terms disclosed at the time of purchase in addition to these Terms.
Unless otherwise stated in the applicable package or membership agreement:
-
Cancellations made with less than 72 hours’ notice may be treated as a missed session and the session may be deducted.
-
A No-Show may result in forfeiture of the scheduled session without refund or rescheduling privileges.
-
Late arrival does not extend the scheduled appointment time.
-
If a client arrives more than 15 minutes late, the appointment may be considered a No-Show and the applicable session may be deducted.
-
Sessions not used within the applicable month do not roll over unless the specific membership agreement states otherwise.
-
Prepaid packages must be used within their stated validity period, beginning on the purchase date unless otherwise stated.
-
A one-time courtesy exception may be considered for an emergency or unforeseen circumstance during a package or membership term. Any such exception is discretionary.
Package and membership terms may vary by promotion or agreement. The written terms applicable to the specific purchase control where they differ from general terms.
16. GIFT CERTIFICATES
Body In Balance Therapy may offer gift certificates through third-party platforms such as Gift Up!, Vagaro, or through physical certificates issued directly by the business.
Gift certificates are subject to the terms disclosed at the time of purchase or issuance, these Terms, our Refund Policy, and applicable law.
Purchased gift certificates are subject to applicable legal requirements concerning expiration, redemption, fees, refunds, restrictions, and other matters.
Unless otherwise authorized:
-
Gift certificates may not be transferred.
-
Gift certificates are not refundable except where required by applicable law or the applicable purchase terms.
-
Gift certificates are not redeemable for cash except where required by applicable law.
-
Verification of the certificate and purchaser or holder may be required.
-
Lost, stolen, altered, damaged, or unauthorized certificates may not be replaced unless the business can verify the certificate and elects to provide a replacement.
-
Gift certificate holders remain subject to applicable appointment, cancellation, rescheduling, late-arrival, and No-Show policies.
Promotional, complimentary, loyalty, courtesy, or other non-purchased certificates may have separate eligibility requirements, restrictions, or validity periods where permitted by law.
Unless otherwise stated, promotional or complimentary certificates may have a one-year validity period where legally permitted.
The format of a gift certificate—electronic or physical—does not change the applicable terms.
Body In Balance Therapy may change or discontinue the sale or issuance of new gift certificates or change the terms applicable to certificates issued after the effective date of a change. We will not apply changes retroactively except where required by law.
Nothing in this section is intended to waive any right that cannot legally be waived.
17. ZERO TOLERANCE POLICY
Body In Balance Therapy maintains a strict zero-tolerance policy regarding sexual misconduct, inappropriate conduct, harassment, threatening behavior, intimidation, abusive behavior, or conduct that compromises the safety, dignity, or professional environment of clients or providers.
Professional services, including massage and bodywork, are performed with appropriate professional draping and boundaries.
The following conduct is prohibited:
-
Sexual acts or sexual contact.
-
Sexual comments, remarks, requests, or advances.
-
Inappropriate touching.
-
Requests for sexual services.
-
Harassment or intimidation.
-
Threatening, abusive, aggressive, or unsafe behavior.
-
Any conduct that makes a provider or another person reasonably feel unsafe or violated.
If prohibited conduct occurs, the service may be terminated immediately.
Body In Balance Therapy may refuse future services and may take other appropriate action, including documenting or reporting serious incidents when appropriate.
Where legally permitted, the business may charge for the scheduled service, including up to the full treatment price, when a service is terminated because of prohibited conduct.
No client is entitled to a refund because a service was terminated due to the client’s prohibited conduct.
18. PAYMENT AND CARD-ON-FILE
A valid credit or debit card may be required to reserve appointments or establish an account.
By providing payment information, you authorize Body In Balance Therapy and its authorized payment processor to process charges that are properly due under these Terms and applicable policies, including applicable service charges, cancellation fees, No-Show fees, package or membership charges, product purchases, and other authorized amounts.
Clients are responsible for maintaining accurate payment information.
If a payment is declined, reversed, disputed, or otherwise unsuccessful, Body In Balance Therapy may require another payment method and may take reasonable steps to collect amounts lawfully due.
19. PAYMENT PROCESSING, SURCHARGES, AND PRICING
Prices for services, products, packages, memberships, and other offerings may be stated on the website, booking platform, point-of-sale system, or other approved business materials.
Prices may change prospectively.
Where permitted by applicable law and payment-network or processor requirements, a surcharge or convenience fee may apply to eligible electronic or card transactions to help offset payment-processing and administrative costs.
Any applicable surcharge or convenience fee will be disclosed as required by applicable law before or at the time of payment.
Clients may inquire about available alternative payment methods.
Body In Balance Therapy does not represent that every payment method will be available for every transaction.
20. RETAIL PRODUCTS
Retail products sold by Body In Balance Therapy are subject to our separate Refund Policy and any applicable manufacturer or product-specific terms.
Clients are encouraged to ask questions about a product before purchase when they need assistance selecting an appropriate product.
Product information is provided for informational purposes and does not constitute medical advice.
Clients are responsible for following product instructions and applicable professional recommendations.
21. REFUNDS AND RETURNS
Refunds, returns, exchanges, prepaid services, retail products, packages, memberships, gift certificates, duplicate charges, and other refund-related matters are governed by the Body In Balance Therapy Refund Policy, which is incorporated into these Terms by reference.
Nothing in the Refund Policy or these Terms is intended to waive rights that cannot legally be waived.
22. PROMOTIONS AND SPECIAL OFFERS
Promotions, discounts, packages, special offers, complimentary enhancements, and other promotional opportunities may be subject to specific terms, eligibility requirements, expiration or validity periods where legally permitted, availability, and other restrictions disclosed at the time of the offer.
Unless expressly stated otherwise, promotions may not be combined with other offers.
Body In Balance Therapy reserves the right to modify, suspend, or discontinue future promotional offers, subject to applicable law and the specific terms of an offer already purchased.
23. PROCELL® AND DERMALOGICA® PRO
Body In Balance Therapy may offer services and products associated with ProCell Therapies and Dermalogica® PRO.
These are distinct professional product or treatment systems and should not be interpreted as the same brand, technology, manufacturer, or treatment modality.
Any trademarks, trade names, logos, or brand names referenced on our website remain the property of their respective owners.
24. THIRD-PARTY WEBSITES, PLATFORMS, AND SERVICES
Our website and business operations may use or link to third-party platforms and services, including booking, payment, ecommerce, gift certificate, social media, analytics, marketing, communication, or other technology providers.
Third-party services are controlled by their respective providers and may have separate terms, privacy policies, fees, technical requirements, and practices.
Body In Balance Therapy is not responsible for the independent operations, availability, content, policies, security practices, or technical failures of third-party platforms.
Your use of a third-party service may be subject to that provider’s separate terms.
25. WEBSITE AVAILABILITY AND TECHNICAL ISSUES
We make reasonable efforts to maintain website availability but do not guarantee that the website will always be available, uninterrupted, secure, error-free, or compatible with every device or browser.
Temporary interruptions may occur because of maintenance, updates, hosting issues, internet or telecommunications problems, third-party services, security incidents, or circumstances beyond our reasonable control.
We are not responsible for losses caused solely by circumstances beyond our reasonable control, except to the extent liability cannot legally be excluded.
26. ACCESSIBILITY
Body In Balance Therapy is committed to providing an accessible and welcoming website and making reasonable efforts to improve accessibility.
Our separate Accessibility Statement describes our accessibility efforts, limitations, and contact information and is incorporated into these Terms by reference.
Third-party platforms and services may have accessibility features and limitations outside our control.
27. INTELLECTUAL PROPERTY
Unless otherwise stated, website content—including text, photographs, graphics, logos, branding, designs, videos, educational materials, layouts, and other original content—is owned by or licensed to Body In Balance Therapy and is protected by applicable intellectual-property laws.
You may view and use website content for your personal, non-commercial purposes.
You may not reproduce, modify, distribute, publish, sell, create derivative works from, or commercially exploit our content without prior written authorization.
Unauthorized use of our branding, content, photographs, logos, or other protected material is prohibited.
28. USER COMMUNICATIONS AND SUBMISSIONS
When you voluntarily submit information, feedback, comments, photographs, reviews, testimonials, or other material to Body In Balance Therapy, you represent that you have the right to provide that material.
You should not submit confidential information through public website features, reviews, social-media comments, or other channels not specifically intended for confidential communications.
We may use information submitted for legitimate business purposes, subject to our Privacy Policy and any permissions or rights applicable to the submission.
29. REVIEWS AND TESTIMONIALS
We value genuine client feedback.
Reviews and testimonials should represent the reviewer’s honest experience.
You may not submit fabricated, misleading, fraudulent, defamatory, or impersonated reviews.
Body In Balance Therapy does not require clients to provide positive reviews in exchange for services, discounts, benefits, or other compensation unless expressly disclosed and legally permitted.
Where a client voluntarily provides identifiable photographs, testimonials, or other promotional material for marketing use, appropriate permission or authorization may be required.
30. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Body In Balance Therapy LLC and its owners, officers, employees, independent contractors, practitioners, service providers, representatives, agents, and affiliates shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the use of our website, services, products, appointments, packages, memberships, gift certificates, or other transactions, except where such limitation is prohibited by law.
To the maximum extent permitted by law, our liability for claims arising from a transaction or service shall be limited to the remedies and amounts permitted under applicable law and the circumstances of the particular claim.
Nothing in these Terms is intended to exclude, limit, or waive liability that cannot legally be excluded, limited, or waived.
31. CLIENT RESPONSIBILITY AND ASSUMPTION OF RISK
By voluntarily receiving services, you acknowledge that you are responsible for providing accurate information, communicating relevant concerns, following reasonable instructions, and informing the practitioner of discomfort or other concerns during a service.
You acknowledge that professional services may carry inherent risks and that individual outcomes vary.
To the extent permitted by law, you assume responsibility for risks that are inherent in the service and for consequences resulting from your failure to provide relevant information or follow reasonable instructions.
Nothing in this section eliminates any legal rights or protections that cannot be waived.
32. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Body In Balance Therapy LLC and its owners, officers, employees, independent contractors, practitioners, service providers, agents, representatives, and affiliates from claims, liabilities, damages, losses, costs, and reasonable expenses arising from or related to:

This provision does not require indemnification to the extent prohibited by applicable law or for matters that legally cannot be shifted to the client.
33. NO WAIVER OF NON-WAIVABLE RIGHTS
Nothing in these Terms is intended to waive, release, limit, or eliminate any right, remedy, protection, or liability that cannot legally be waived or limited under applicable law.
If applicable law provides a mandatory consumer protection or other non-waivable right, that right remains unaffected.
34. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.
If modification is not legally possible, the affected provision shall be severed to the extent necessary, and the remaining provisions shall continue in effect.
35. DISPUTE RESOLUTION
If a dispute arises concerning our website, services, purchases, appointments, or these Terms, the parties are encouraged to first attempt to resolve the matter in good faith by communicating directly with Body In Balance Therapy.
Nothing in this section creates mandatory arbitration or waives a legal right unless a separate written agreement expressly provides for it.
Any formal dispute-resolution process will be governed by applicable law and any enforceable written agreement applicable to the particular transaction.
36. GOVERNING LAW
These Terms and the relationship between you and Body In Balance Therapy shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent federal law or other applicable law requires otherwise.
37. CHANGES TO POLICIES AND PRICES
Body In Balance Therapy reserves the right to modify its policies, services, prices, website content, and these Terms from time to time.
Changes will generally apply prospectively from the effective date stated in the revised Terms.
We may post revised Terms on the website and update the “Last Updated” date.
Your continued use of the website or participation in services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
